Selected excerpts

The monograph presented is a large-scale and systematic study devoted to the formation and development of international construction law as an independent field of legal scholarship.

The author has succeeded in consolidating and organizing the previously fragmented aspects of legal regulation applicable to cross-border infrastructure projects into a coherent framework.

The principal merit of the work lies not only in identifying the causes of fragmentation and inconsistency of current approaches, but also in defining the unique subject matter, the normative sources, and the regulatory mechanisms of this emerging field.

The study features a comprehensive structure. The first and second chapters address the methodological and historical-legal foundations of the subject. The third and fourth chapters examine the integration of international standards and norms into national legal systems. The eighth and ninth chapters deal with practical issues, including dispute resolution and relevant adjudicatory practice.

Special attention is given to the analysis of foreign and international practice in the regulation of construction relations. The intersections of international construction law with international public law, international private law, and conflict-of-laws regulation are also identified.

The scientific novelty of the research is associated with the author’s development of an integrative concept of international construction law. The work substantiates a draft definition of the field and develops the idea of lex constructionis. A number of concepts relevant to the subject are introduced and academically grounded.

The practical value of the work is reinforced by its applicability for students, researchers, and practitioners. Particular attention is paid to the systematized analysis of FIDIC standards and their legal significance.

Taking the above into account, the monograph can be recommended for publication and for use in academic and practical activities.
